ABS-CBN readies 'bigger' case vs GMA 7 over Angelo video

ABS-CBN Broadcasting Corp. is set to file a multimillion-peso infringement case tomorrow against its biggest rival network, GMA 7, for the latter's use of ABS-CBN's live video feed of freed hostage Angelo de la Cruz last week.

Inquirer Entertainment learned last Friday that the infringement case would be bigger than the P100-million libel case GMA 7 filed against ABS-CBN last July 27.

In a statement sent to Inquirer Entertainment, ABS-CBN pointed out that "GMA 7 openly admitted that it used more than two minutes of ABS-CBN's live video feed of De la Cruz despite knowing that this is not allowed.

"(GMA Network) also knows that (ABS-CBN's) contract with Reuters and CNN prohibits the use of any video without permission," especially for locally based stations, the ABS-CBN statement said.

According to ABS-CBN, the De la Cruz video was "clearly marked" "No Access to Philippines." This means the video was intended only for ABS-CBN and international networks such as Reuters

and CNN, and no other Philippine station, including GMA 7, could use it without ABS-CBN's consent.

"It is well-known in the community that ABS-CBN has always provided live coverage to Reuters and Associated Press for their international broadcasts," said the ABS-CBN statement.

"The whole ABS-CBN workforce has made every effort in bringing the Filipino people, as well as the whole world, the latest news and video," the ABS-CBN statement added. "It has strived to uphold the interests of the viewers, advertisers and the whole nation above its own. While ABS-CBN respects the right of the rival network to file any case against it, (ABS-CBN) shall remain committed to thwart any efforts aimed at silencing the truth."

GMA Network had filed the libel case last week "after ABS-CBN blatantly and repeatedly accused the network of stealing their Angelo de la Cruz footage," GMA 7 said in a statement. Charged with libel were ABS-CBN chair and CEO Eugenio Lopez III, president Luis Alejandro, news anchor Erwin Tulfo, reporter Lynda Jumilla, SVP for news and current affairs Jose Ramon Olivares, VP for news operations Jesus Maderazo, VP for news productions Luisita Cruz-Valdes, AVP for news operations Jose Magsaysay Jr., director for news operations Alfonso Marquez;

"Insider" executive producer Beth Frondoso, "Magandang Umaga Bayan" supervising producer Maria Progena Estonilo Reyes, "Magandang Umaga Bayan" executive producer Annie Eugenio, and "News Patrol" executive producer Dondi Garcia.

GMA 7's libel complaint stemmed from statements made by Tulfo and Jumilla accusing GMA 7 of stealing, on the July 22 edition of ABS-CBN's news program "Insider" and on the July 23 edition of the morning current affairs program "Magandang Umaga Bayan."

GMA 7 had said it has never been its policy or practice to air footage that it is not authorized to put on the air.

Last July 22, GMA 7's hourly news update, "Flash Report," carried Reuters' live video footage from the Ninoy Aquino International Airport on De la Cruz's arrival. GMA 7 alternately used its own footage with those beamed live by Reuters.

GMA 7 said that when ABS-CBN reporter Dindo Amparo appeared on the live Reuters feed, GMA 7 immediately stopped broadcasting the Reuters pictures and switched to CNN's live coverage of the event. But CNN was also picking up Reuters' live video feed, according to GMA 7 VP for legal affairs d!ck Perez.

GMA 7 is a subscriber to both Reuters and CNN.

Both GMA 7 and ABS-CBN have been showing regular plugs explaining their stand on the issue.

such imprudence of GMA network.. even though they got it from CNN or Reuters, they might have obviously known that it was provided by ABS-CBN their rival network.

and about the case, i wont comment on it. law is not my major. (IMG:http://www.asiafinest.com/forum/style_emoticons/default/embarassedlaugh.gif)

There were a lot of Chinovelas and Koreanovelas in that Channel like "Outsiders" every 6:30 pm Monday- Friday, " Crouching Tiger Hidden Dragon " series at 9:00 pm. Iba Tayo!
