According to the website FOSS Patents Florian Mueller report, the latest court documents of MOTOROLA Sue apple show the company would like to own apple wireless equipment 2.25% of sales amount as a patent license fee. The figures come from MOTOROLA and Qualcomm patent license file, apple says the patent of its own equipment may have already won authorized from Qualcomm baseband chip.

Apple in a document says MOTOROLA demand 2.25% of patent fees is very unfair, the problem of the patent is FRAND type, this means that MOTOROLA have to authorize the use of competitors. At the same time apple also proposed to check the patent license between MOTOROLA and nokia, HTC, LG, and Ericsson, this can judge whether MOTOROLA overcharge apple.

Although the file did not mention 2.25% of the cost sales cover all of the patent, but Mueller says if apple accept, the struggle between MOTOROLA and apple patent may be over, for to a single patent, cost is too great.

Problem patent related to the recommendation, affected apple products are iCloud and MobileMe. Friday Apple quickly rip off 3 G equipment from online store, but then these equipment went back online, the reason why apple appeal is MOTOROLA refuses to give apple the patent license.

If the last survey found that MOTOROLA didn't really authorized apple FRAND patent of words, then the company will face antitrust department investigation from the European. At present samsung are being investigated, Mueller speculated that apple will launched the same attack to MOTOROLA.
