Singapore, Indonesia to sign extradition treaty, defence pact on Friday

SINGAPORE : After a few years of negotiations, Singapore and Indonesia have completed discussions on two bilateral issues - an Extradition Treaty and a Defence Cooperation Agreement.

The foreign and defence ministers from both countries will be signing the agreements in Bali on Friday.

The signing will be observed by Singapore's Prime Minister Lee Hsien Loong and Indonesian President Susilo Bambang Yudhoyono.

These details were revealed by Foreign Affairs Minister George Yeo and his Indonesian counterpart Hassan Wirajuda in a news conference on Monday.

In the latest round of talks, both sides had been negotiating for two days and one night, right up to the minutes just before the news conference.

Mr Yeo said officials from Singapore and Indonesia had done good work in bridging outstanding issues. They also managed to close the gaps.

Mr Yeo said: "The talks were characterised by a high degree of cooperation, friendship, flexibility and goodwill, and because goodwill was in ample supply on both sides, we are able to reach a good agreement for both the extradition treaty and the defence cooperation. Both agreements will help us lay a strong foundation for further cooperation in the future."

Agreeing, Dr Hassan said the agreement was a result of the hard work and determination of both countries to work together as "friends and neighbours".

"Indonesia and Singapore are good neighbours and we are determined to expand and deepen our bilateral ties. I believe that the conclusion of the two agreements will contribute in our joint efforts to strengthen our bilateral ties," he said.

Dr Hassan added that it had been a "long and arduous process".

More details of the agreements reached were not disclosed.

For now, what is confirmed is that Singapore and Indonesia will sign both the Extradition Treaty and a Defence Cooperation Agreement in a ceremony on the island of Bali on Friday.

Mr Lee and Dr Yudhoyono will be witnessing the ceremony.

The two leaders had agreed in October 2005, when they met in Bali, that the treaty and agreement will be negotiated in parallel, and that one cannot be concluded without the other.

Since then, chief negotiators have been hard at work. On Monday, the final details were ironed out.

Mr Yeo, Defence Minister Teo Chee Hean and Chief of Defence Force Major-General Desmond Kuek, met their Indonesian counterparts in Singapore.

The group was then briefed by their chief negotiators before another round of joint discussions.

By evening, both sides had reached an agreement on all remaining issues. - CNA/ms/de

AN extradition pact between Indonesia and Singapore agreed late on Monday won't frighten rich Indonesians away from Singapore or hurt the island's property and banking sectors, Singapore senior statesman Lee Kuan Yew said on Tuesday, April 24.

"It's laughable. Do you believe that any Indonesian who was likely to be extradited would be here at all?" Lee said in an interview with Reuters.

"It does act as an inhibitor. It does give an extra barrier for any would-be escapee from their system," Lee said.

The two countries reached an agreement on the treaty after several years of wrangling over the issue, although no details were released ahead of the signing due to take place in Bali on Friday.

Indonesia has long expressed a desire for an extradition treaty with Singapore because of its concerns that some Indonesians, for example those who owed money to the authorities following the 1997-98 financial crisis, had taken refuge in the neighbouring city-state.

Lee said Singapore had very strict rules to prevent money-laundering.

Singapore is home to a large number of wealthy Indonesians. They are key players in the property market and big business for private banks.

One third of Singapore's high net-worth investors -- those with net financial assets of more than $1 million -- are of Indonesian origin, Merrill Lynch and Capgemini said in a report, adding that these 18,000 Indonesians had total assets of $87 billion.

In January, Indonesia banned sand exports to Singapore, citing environmental concerns and the need to protect its borders. Two months later, Jakarta said it was also considering banning granite chip exports to the city-state.

However, some Indonesian officials were quoted in the local media as saying the sand export ban was intended to put pressure on Singapore to speed up talks on the extradition treaty.

The sand ban has forced Singapore to look for alternative sources of sand -- including China, Vietnam and Myanmar -- to feed a construction boom.

JAKARTA, April 24 (Bernama) -- Indonesian Attorney-General Abdurahman Saleh hopes the extradition treaty to be signed by the Indonesian and Singaporean governments soon will be retroactive so that it can be used to net corrupters from former president Suharto`s era.

"I have not read the treaty’s draft but I hope it will be retroactive by five years. In short, I hope it can also be applied to corrupters from the Suharto era," he said as quoted by Antara news agency after attending a limited cabinet meeting here Tuesday.

Indonesia and Singapore officials are expected to sign the extradition treaty and a defence co-operation agreement at the Tampak Siring presidential Palace in Bali on Friday, witnessed by Indonesian President Susilo Bambang Yudhoyono and Singapore Prime Minister Lee Hsien Loong.

Abdurahman said the Indonesian government had from the beginning hoped the agreement could be used retroactively to cover past corrupters, including those involved in the Bank Indonesia Liquidity Assistance (BLBI) scandal.

The government had been hoping that with the treaty it could more easily net corrupters who had fled to Singapore, he said, adding that "we expect to be able to bring those corrupters back."

Under the accord, Abdurahman said Singapore was also obliged to extradite alleged corrupters who had fled to that country to Indonesia.

He, however, admitted that the problem was not that easy as it was not impossible that they have already left Singapore when both the governments were still discussing the agreement.

Justice and Human Rights Minister Hamid Awalloedin welcomed signing of the agreement as it had been awaited for a long time because it would affect law enforcement in the country.

Foreign Minister Hassan Wirajuda said the agreement would affect 42 criminal cases.

On data of the corrupters that Singapore had received, the minister said the two countries have not discussed matters relating to the treaty’s implementation.

"We are just in the stage of agreeing on the pact which is good for our purpose and the two countries` common interests. We have not talked about who and how but we are striving maximally to make the agreement appropriate for use to meet our purposes," he added.

What a relief! Finally! I still remember the day I was in my class listening to my lecturer that Singapore and Indonesia doesn't have any extradition law. I thought, gee, that's stupid. We're very close to each other, for God's sake! I remember having hatred toward Singapore's unwillingness to cooperate because they don't want to hurt their economy, and I still hold grudges until recently. Thank goodness for this agreement. Now we can be good neighbors, and who knows, maybe friends icon_wink.gif

no..i read news paper today...and its confirmed...im not sure the exact year but its definetely not only for future corruptor...were stupid but not that stupid to sign a very disadvantage treaty...

Spore want to make treaty not only because they can buy sand from Indo again but they can use some indo teritory for military training..bcause u know..its a very small country....the military planes easily pass Indo borders 3 minutes after take off..so, its so difficult for them to do military training....

on details of the treaty.....what you read is the public speculation. The details had not been broadcast to the general public yet. But I think i have to agree with you that SG will succumb to indo pressure on backdating the treaty to suharto eras

this treaty is a packaged treaty and yes ...it would come together with joint military operation where indo freeze it since 2003 if I am not mistaken

Singapore, Indonesia sign Defence Cooperation Agreement

SINGAPORE: The strong defence ties between Singapore and Indonesia are set to be further enhanced, with the signing of their Defence Cooperation Agreement (DCA) on Friday.

The DCA was negotiated in parallel with the Extradition Treaty and concluded together as one package.

The two documents were signed at a ceremony in Bali.

The event was witnessed by Singapore's Prime Minister Lee Hsien Loong and Indonesian President Susilo Bambang Yudhoyono.

The Singapore-Indonesia Defence Cooperation Agreement provides a comprehensive strategic framework to promote bilateral defence ties and enhance the professionalism and inter-operability of the two armed forces.

This will be done through greater mutual access to each other's training areas and facilities.

The scope of cooperation also includes developing joint training areas and facilities in Indonesia, providing training assistance to the Indonesian National Defence Force and access to training areas in Indonesia for the Singapore Armed Forces.

The Singapore-Indonesia Extradition Treaty lists the offences for which a person can be extradited.

These offences are those under Singapore's Extradition Act and include acts such as murder, inflicting grievous hurt, kidnapping, bribery and other acts of corruption, forgery, stealing, embezzlement, money laundering, hijacking of ships and aircraft, and terrorism financing.

These offences must be punishable according to laws of both parties by a jail term of not less than 24 months or by a more severe penalty.

The document also contains an extensive set of safeguards to ensure only bona fide extradition requests will be entertained.

It states that extradition will be refused where the requested party has grounds to believe that the request is made for prosecuting the person on account of his race, religion, nationality, ethnic origin or political opinions.

Extradition will also be refused if the person concerned is involved in an investigation that is in progress or a prosecution that is pending in Singapore.

It will also be refused if the fugitive is being lawfully detained under Singapore law.

Political watchers say the signing of the documents brings to an end a long period of negotiations between both countries.

But there still lies ahead another key task - that is, the ratification of the two agreements before they can be enforced.

In Indonesia's case, they have to be ratified by its Parliament.

In Singapore's case, the agreements are ratified by the Cabinet.

Observers also say Singapore and Indonesia can now shift their focus to other areas, like the development of special economic zones in Batam, cooperation in tackling the haze and strengthening ASEAN's role in the international community. - CNA/yy

Indonesia hopes treaty with Singapore will help recover embezzled billions

BALI, Indonesia (AP) -- Indonesia said it hopes an extradition treaty it was set to sign Friday with Singapore will help recover billions of dollars (euros) of government funds embezzled to the city-state during the 1997 Asian financial crisis.

The agreement was to be signed on the resort island of Bali during a ceremony attended by Indonesian President Susilo Bambang Yudhoyono and Prime Minister Lee Hsien of Singapore.

But concerns have already been raised that it may be ineffective because an unknown number of suspects have changed their nationalities. Singapore is believed to be a haven for around 200 suspect Indonesians, many whom fled the country with stolen funds as the banking system collapsed in 1997.

No figures or names have been released by the Indonesian government, but Merrill Lynch and Cap Gemini said last year in a report that around 18,000 wealthy Indonesians live in Singapore with a total net worth of US$89 billion (€66 billion).

Teten Masduki, the founder of Indonesia Corruption Watch, believes tens of billions of U.S. dollars (euros) have been stockpiled in Singapore by Indonesian conglomerates during the decade since the financial crisis.

"We hope with the treaty will enable Indonesia to easily prosecute corrupt business people and politicians," Masduki said, accusing Singapore of failing to question the source of potentially dirty funds in its banks.

Indonesian Attorney General Abdul Rachman Saleh said the treaty, based on U.N. conventions, will cover crimes dating back "more than five years" to the reign of former dictator Suharto, but details of the agreement ironed out this week have not been published.

"It should and can return the assets of the corrupt officials to the country of origin," he told reporters.

Yunus Hussein, head of an agency tracking suspect transactions, said it can be useful "as long as it also covers the proceeds of crimes hidden in Singapore" and is retroactive to 1992.

Indonesia was among the worst hit by the Asian financial crisis, which ravaged the banking system and thrust the nation into years of recession, eventually toppling President Suharto after more than three decades of brutal rule.

The economy is still recovering, but poverty and unemployment are widespread.

About the sand ban, there is nothing mentioned about it in the treaty so the embargo still stands, no Indonesian sand will be going to Singapore.

Indonesian President Susilo Bambang Yudhoyono and Singapore Prime Minister Lee Hsien Loong witnessed the signing that took place in a sprawling, Balinese-style palace.


The treaty has to be ratified by parliaments in both nations.

Indonesia had long sought an extradition treaty with Singapore because of its concerns that some Indonesians, for example those who owed money to the authorities following the 1997-98 financial crisis, had taken refuge in the neighbouring city-state.

The new treaty applies retroactively to cover crimes that took place 15 years earlier.

Singapore is home to a large number of wealthy Indonesians. They are key players in the property market and big business for private banks.

Environmentalists also allege that funds from massive illegal logging in Indonesia have been transferred to Singapore.

Singapore, which is keen to develop its banking sector and attract high-net worth indivuals, insists it has strict money laundering laws to curb such economic crimes.

In February, Jakarta banned exports of sand to Singapore on the grounds that sand quarrying had damaged the environment.

But some saw the move as a way to pressure the city-state to sign the extradition treaty.

The two countries also signed a defence cooperation pact which Singapore described as a mutually beneficial agreement that will strengthen security ties between the two countries.

The pact will provide for training assistance to the Indonesian military and access to training areas in Indonesia for the Singapore Air Force and navy, Singapore’s defence ministry said in a statement posted on its Web site.

The defence pact will remain in force for 25 years.

now that INA got wat they wanted:

1. what and how INA going to do now?
2. is the sand & granite ban would be lifted?
3. how does this effect the global perception towards doing business with INA when INA uses pressure to get what they wanted?

Err.. how can we're the one to blame when it's obvious that Singapore had been displaying a bad intention by rejecting Indonesia's advances for extradition treaty in the past? This treaty could have solved a lot of problems, yet Singapore is vicious enough to do such scene to it's neighbor.

Anyway, I know that Singaporeans are not the ones to blame, after all it's all about government's politics. And about the bans, we can always re-evaluate. If it's proven that they would do damage to the environment, then maybe we should find alternative measures...

DPR-DPD asal Kepri Harus Tolak Ratifikasi

JAKARTA (BP) - HUBUNGAN Indonesia dengan Singapura nampaknya mulai memasuki babak baru. Situasi memanas pascapenandatanganan perjanjian ekstradisi yang disejalankan dengan perjanjian pertahanan di Tampak Siring, Bali, bulan lalu.

Mantan Ketua MPR RI Amien Rais meminta agar perjanjian kerja sama pertahanan atau Defense Cooperation Agreement (DCA) antara Indonesia dan Singapura direvisi. Alasannya, posisi Singapura yang diuntungkan dengan diberikannya akses untuk menggunakan wilayah darat, laut dan udara, justru sangat merugikan Indonesia

’’Ini sangat merugikan. Harus direvisi. Jangan sampai kita seperti kerbau yang dicocok hidungnya, dalam segala hal takut dengan Singapura. Bangsa macam apa ini?” ujar Amien kepada wartawan, di Jakarta, kemarin, usai menjadi pembicara pada diskusi bertema Tegakkan Hukum dan Bangkit Melawan Korupsi yang diselenggarakan Masyarakat Profesional Madani di Hotel Sultan, Jakarta.

Menurut guru besar ilmu hubungan internasional di Universitas Gadjah Mada itu, ada dua kerugian yang harus ditanggung sebagai akibat ditandatanganinya DCA pada 27 April silam. Pertama, kata Amien, lamanya perjanjian yang berlaku hingga 25 tahun dengan 13 tahun pertama yang tidak bisa diutak-atik amat sangat merugikan.

’’Kedua, diizinkannya Singapura menggunakan wilayah untuk perang-perangan di darat sampai Baturaja di dekat Palembang, ataupun wilayah udara dan laut di Kepri itu terlalu menjorok ke dalam wilayah kita,” kata mantan ketua MPR itu.

Selain itu, katanya, adanya pernyataan Menteri Pertahanan Prof Dr Juwono Sudarsono bahwa pemerintah akan merivisi draf defense spec sebagai aturan pelaksana perjanjian kerja sama pertahanan justru semakin menunjukkan pihak Indonesia memang dirugikan dengan perjanjian tersebut. ’’Karena itu saya setuju kalau Pak Juwono (Menhan, red) mau merevisinya karena faktanya, kita memang dirugikan,” ujar Amien.

Menurut mantan calon presiden pada Pipres 2004 itu, pemerintah memang bersikap tertutup dalam masalah DCA maupun Extradition Treaty. Bahkan, kata Amien, ia mengaku mendapat kedua draft perjanjian itu justru dari koleganya di Singapura.

’’Draf itu perlu ratifikasi. Faktanya teman-teman di Komisi I belum menerima. Padahal wakil rakyat harus baca drafnya. Di website-nya Deplu juga tidak ada. Akhirnya kita dapat dari Singapura,” ungkapnya.
Perihal sikap tertutup pemerintah itu juga diungkapkan Idris Zaini, wakil rakyat dari Kepri yang duduk di Dewan Perwakilan Daerah (DPD). Menurutnya, masyarakat Kepri yang akan menerima imbas langsung dari perjanjian itu tidak pernah dilibatkan ataupun diajak bicara.

’’Ini bukan soal kompensasi apa yang harus diterima warga Kepri. Tetapi warga Kepri tidak pernah diajak bicara. Apa ada jaminan bahwa jika nanti latihan digelar tidak akan ada rudal nyasar? Kita kecewa dan ini pelecehan karena pusat telah menabrak hak daerah,” ujar Idris.

Lebih lanjut politisi asal Natuna itu menambahkan, sekalipun urusan pertahanan adalah domain pemerintah pusat, namun karena dalam hal ini wilayah Kepri telah dijadikan sebagai area latihan perang, maka keselamatan warga Kepri juga harus diperhatikan.

Idris justru menuding pemerintah Indonesia tidak tanggap dengan letak strategis Natuna dan Anambas. Alasannya, Natuna dan Anambas selama ini juga mejadi incaran Cina dan Vietnam. Selain itu, katanya, dalam master plan yang dicanangkan oleh Presiden BJ Habibi dalam Visi 2020, Natuna dan Anambas akan dijadikan pusat logistik bagi dunia pelayaran, jika nanti terusan Kra di Thailand dibuka.

Karenanya, Idris berjanji untuk mempermasalahkan perjanjian kerja sama pertahahan dengan Singapura itu. ’’Kita akan menggalang dukungan dari teman-teman di DPD, agar secara resmi DPD menyurati pemerintah sebagai bentuk keprhatinan. Kita juga akan mengajak Pemda untuk menanyakan masalah ini ke pusat,’’ tukasnya.

Tolak Ratifikasi

Dalam pada itu, perjanjian pertahanan antara Indonesia dengan Singapura yang memperbolehkan wilayah Kepulauan Riau dijadikan arena latihan perang, dinilai mengorbankan kedaulatan negara Republik Indonesia. Wakil rakyat asal Kepri harus berjuang keras menolak ratifikasi perjanjian kerja sama pertahanan atau Defence Cooperation Agrement (DCA) tersebut.

’’Setelah perjanjian tersebut diratifikasi DPR, maka Kepulauan Riau jadi wilayah Singapura. Sebab, latihan perang Singapura itu sampai ke Anambas. Ini mungkin konsesi dari perjanjian ekstradisi, tapi tidak seimbang,” kata peneliti senior Lembaga Ilmu Pengetahuan Indonesia (LIPI) dan pakar politik Asia Tenggara DR Alfitra Salamm, kepada Batam Pos kemarin.

Menurut Alfitra Salamm, perjanjian yang belum diratifikasi Dewan Perwakilan Rakyat (DPR) itu, harus ditinjau ulang. ’’Indonesia terlalu lemah ketika berhadapan dengan Singapura. Konsesi yang diberikan dengan perjanjian ekstradisi ya melalui latihan-latihan perang itu,’’ ujarnya.

Dikatakan Alfitra, seharusnya, wakil-wakil rakyat, baik di DPR maupun DPD asal Kepulauan Riau, menolak perjanjian itu diratifikasi, untuk kepentingan warga Kepri. ’’Tapi, saya pesimis karena kita udah tak bisa berbuat apa-apa,” katanya.

Anggota DPD asal Kepri Idris Zaini mengatakan, akan memperjuangkan revisi isi perjanjian tersebut. ’’Kami juga akan berjuang di DPD agar perjanjian ini direvisi. Kami masih mempelajari isi perjajian itu,’’ kata Idris.
’’Pemerintah pusat jelas-jelas melecehkan kedaulatan daerah (Provinsi Kepri), apalagi perjanjian itu dibuat tanpa ada konsultasi publik di daerah. Ini tidak boleh dibiarkan, harus direvisi,’’ ujar Idris menambahkan.

Sangat naif, kata Idris, menjadikan wilayah Provinsi Kepri sebagai pusat latihan militer Singapura, sebagai bentuk kompensasi perjanjian ekstradisi RI-Singapura. Sebuah kompensasi yang sangat tidak seimbang, apalagi Indonesia, khususnya Provinsi Kepri tidak mendapatkan pemasukan apa-apa dari kerja sama latihan itu.

Anggota DPR RI asal Provinsi Kepri Harry Azhar Azis mengatakan, perjanjian tersebut masih bisa dimentahkan oleh DPR RI. Apalagi, jika dipandang kerja sama itu tidak membawa manfaat bagi wilayah Provinsi Kepri.

Penolakan masyarakat Provinsi Kepri, juga menjadi salah satu pertimbangan penting baginya dan bagi anggota DPR RI lainnya, untuk memberikan persetujuan atau tidak atas kerja sama tersebut. ’’Meski sudah ditandatangani antara Pemerintah Singapura-Indonesia, tidak bisa langsung diberlakukan. Tanpa persetujuan DPR RI, tidak boleh ada latihan militer Singapura di wilayah Provinsi Kepri,’’ tegasnya.

Bahayakan Nelayan

Kekhawatiran ditetapkannya Kepri sebagai arena latihan perang juga datang dari Ketua DPRD Natuna Rahman Sahari. Menurutnya, kewibawaan sebagai negara besar di Asia akan hilang dengan masuknya kapal asing membawa senjata perang di wilayah Indonesia. ’’Belum lagi latihan itu membahayakan bagi masyarakat, yang kebanyakan nelayan,” jelasnya.

Dulu, cerita Rahman, TNI sendiri pernah melakukan latihan perang di Natuna. Saat latihan tersebut, penduduk Natuna tidak berani keluar rumah karena dilanda kecemasan yang luar biasa. ’’Bayangin itu senjata tajam pak, bisa membunuh banyak orang sekaligus. Mendengar suaranya saja, masyarakat sudah ketakutan. Kalau yang jantungan bisa mati mendadak,” ujar Rahman, yang ketika dihubungi sedang di Jakarta mengikuti pelatihan Up Grading for Good Govermant, 22-25 Mei 2007 di Hotel Aston.

Mumpung masih di Jakarta, janji Rahman, jika ia bertemu dengan Ketua DPR RI Agung Laksono, secara pribadi dan institusi, pihaknya meminta agar kerja sama pertahanan dengan melakukan latihan militer di Natuna itu dikaji ulang. ’’Masa halaman kita, kita berikan kepada orang lain untuk latihan perang. Itu sama dengan mencoreng kedaulatan negara kita. Kalau mau latihan, kan masih banyak laut lepas,” ujarnya.

Diakuinya, perjanjian pertahanan keamanan dengan latihan militer bersama di Natuna itu, memang pekerjaan pemerintah pusat. Akan tetapi, ia menilai, tidak ada salahnya pemerintah pusat bertanya dulu ke orang daerah, setuju atau tidak dengan latihan perang tersebut. ’’Kalau ada aspirasi masyarakat Natuna soal ini, kami siap membawanya ke pusat. Kami menunggu itu, karena itu salah satu tugas dewan memperhatikan aspirasi masyarakat,” pintanya.

Rasional dari Perjanjian Kerja Sama Pertahanan (PKSP) antara dua atau beberapa negara adalah secara esensial, demi security (terjaminnya keamanan, ketentraman, kebebasan) dari negara-negara yang bersangkutan. Setelah mempelajari teks PKSP antara Indonesia dan Singapura, saya jadi terperangah, tidak habis pikir. Betapa tidak. Apakah tanpa PKSP ini sekuriti Indonesia tidak terjamin? Dengan kondisi sosio politik regional dan mondial dewasa ini, jangankan Singapura, Amerika Serikat saja tidak akan dapat memupus Indonesia dari peta dunia tanpa resiko.

Baru sekali dalam sejarah human satu negara besar dalam artian fisik (Indonesia) merasa perlu mengadakan PKSP dengan satu negara kecil (Singapura) demi sekuritinya. Dengan kata lain, si besar memerlukan "perlindungan" dan "jaminan" dari si kecil! Apakah angkatan bersenjata Indonesia memang sudah begitu loyo hingga tidak bisa lagi dihandalkan menjamin ketahanan nasional?

Pemikir " the art of war " China klasik, Sun Tzu, mengatakan bahwa bila membangun ketangguhan pertahanan sepenuhnya merupakan kekuasaan dan urusan diri sendiri, untuk memenangkan perang tergantung pada peluang yang diberikan oleh lawan. Dan Indonesia, melalui PKSP yang dibangga-banggakannya sebagai suatu kemenangan besar, telah menyajikan peluang tersebut di atas "baki emas" kepada Singapura.

Singapura dibolehkan mengadakan latihan perang di laut dan udara wilayah Indonesia, sedangkan angkatan bersenjata Indonesia tidak bisa menikmati kesempatan yang serupa di wilayah Singapura. Dan tidak hanya ini. Singapura bahkan boleh mengikutsertakan angkatan bersenjata dari "other countries" -jadi negara ketiga- dalam latihan perangnya di wilayah kita. Dapat dibayangkan betapa banyaknya "negara lain" yang pasti bergairah untuk ikut serta "thanks to Singapore". Australia, Jepang yang kini sudah dibenarkan punya Departemen Pertahanan, China dan tentunya Amerika Serikat yang selalu merasa terpanggil untuk menjadi polisi dunia, yang kapal selam nuklirnya bisa mondar-mandir di Selat Makasar dan Selat Lombok tanpa terdeteksi oleh sistem pertahanan kita.

Benar bahwa semua itu bisa terjadi bila disetujui oleh Indonesia. Berarti yang menolak, jadi tidak simpatik, adalah tetap Indonesia, bukan Singapura. Sebaliknya negara kecil ini dengan ajakannya itu, diterima atau ditolak Indonesia, tetap memanen citra yang mulia sebagai negara yang "iklas" dan "terbuka".

Kalau ia benar-benar ikhlas, mengapa ia tidak cukup dengan Indonesia saja dalam berlatih perang? Kalau ia toh ingin berlatih itu dengan "other countries", mengapa ia tidak membuat PKSP dengan "those other countries" di wilayah nasional masing-masing. Saya betul-betul tidak habis pikir mengapa klausul yang begitu menjebak bisa masuk dalam teks PKSP dan ditandantangani dengan penuh senyum!

Kalau kita lihat "training ground" yang diizinkan Indonesia dalam peta yang terlampir pada PKSP, kita akan menjadi lebih terperanjat lagi melihat "kemurahan hati" atau kepicikan visi strategis dari para juru runding kita. Yang disebut dengan kode area Alpha Satu, Alpha Dua dan Bravo, adalah persis yang dinamakan "verkennings zone" oleh Koninklijke Marine di zaman Hindia Belanda dahulu. Disebut begitu karena semua itu merupakan wilayah pertahanan laut yang khusus disiapkan, jadi sangat dieman-eman, untuk bisa menghadapi "ancaman" dari ke- kuatan laut Inggris yang berpusat di Singapura (Alpha Satu), dari Amerika di Manila sesuai konsep Admiral Mahan (Alpha Dua dan Bravo) dan belakangan dari Jepang. Di tahun 1902 Jepang dan Inggris mengadakan "vloot-verdrag" yang cukup menimbulkan kewaspadaan angkatan laut Kerajaan Belanda. Jadi PKSP ini malah berpotensi membahayakan sekuriti Indonesia.

Pikiran penguasa Belanda mengenai tujuan maritim-strategis demi pertahanan Hindia Belanda di tahun 20-an berikut semua petanya dapat dibaca dalam buku yagn ditulis oleh Dr Mr G Jungsler berjudul " Recht Zo Die Gatt" ( 's-Gravenhage, 1991).

Dapat disimpulkan bahwa PKSP Indonesia - Singapura hanya menguntungkan Singapura di atas kebuntungan Indoensia. Ia yang mendapat manfaat bukan kita. Belum lagi dihitung " fringe benefits" yang jauh lebih bisa ia nikmati ketimbang kita dengan pengkaitan perjanjian pertahanan dengan perjanjian ekstradisi. Belum lagi diingat gangguan kenyamanan dan ketentraman hidup dan bekerja sehari-hari dari rakyat kita yang bermukim di training ground tadi serta resiko kerusakan alam dan lingkungan disitu karena adanya latihan-latihan perang.

Ada dikatakan bahwa perundingan peraturan pelaksanaan dari kerja sama pertahanan ini, khusus terkait penggunaan area latihan militer Bravo, diserahkan kepada Deplu. Bagaimana bisa mengandalkan urusan yang begitu penting kepada Departemen yang dalam mengambil keputusan hanya berpegang pada asas bebas-aktif, tidak bersendikan konsep geopolitik dan geostrategi yang menetapkan alternatif-alternatif yang musti diputuskan menurut asas kerja tadi. Jangankan Deplu, Pemerintah sebagai keseluruhan juga mengesankan tidak punya visi geografi sebagai dasar berpi- jak dan berpikir, selalu bekerja pragmatis.

Sebaliknya negara mini Singapura, "a geographically disadvantaged state", beruntung dipimpin oleh orang-orang yang bervisi maksi. Mula-mula mereka menganggap Singapura, secara geografis, sebagai Nederland di Eropa. Sebuah negara kecil, tanpa sumber alam yang berarti, yang dikelilingi oleh negara-negara besar maju. Maka ekonomi nasionalnya dibangun menjadi suatu knowledge economy.

Lalu mereka perlakukan Singapura bagai Swiss yang berada di antara negara-negara besar yang gemar berperang. Mereka bangun suatu sistem perbankan yang bisa dipercaya untuk "penitipan" kekayaan, terutama uang. Bersamaan dengan itu mereka bina sistem informasi, dengan pengetahuan yang mereka miliki, yang tangguh hingga informasi mengenai uang bisa menjadi lebih penting daripada uang itu sendiri.

Akhirnya mereka umpamakan negerinya senasib dengan Israel yang "dikepung" oleh negeri-negeri yang tidak bersahabat, namun selalu bingung dan kalap. Maka mereka berusaha keras memanfaatkan kebingungan dan kebuntuan pikiran tersebut dan melihat Indonesia sebagai negeri yang mudah dibujuk dan diiming-iming.

Maka PKPS dengan Singapura sebaiknya dibatalkan. Singapura yang memerlukan itu bukan kita. Kalau sudah menyinggung soal hukum, mereka selalu sok correct demi pemurnian citranya. Jangan pernah lupa bagaimana mereka tetap menghukum mati prajurit kita yang tertangkap ketika berinfiltrasi ke Singapura dalam rangka konfrontasi dengan Malaysia dahulu. Padahal pembesar kita sudah nyaris menyembah mereka demi pembebasan prajurit yang malang itu.

Mari menggunakan pembatalan PKSP ini sebagai kesempatan merumuskan satu geopolitik dan geostragi yang berlaku sebagai visi dasar pembangunan nasional kita di semua bidang. Semua ini sudah pernah saya tulis berupa aneka ragam artikel, risalah dan esai. Khusus mengenai pembangunan ketahanan nasional yang sesuai dengan kondisi alami Indonesia, yaitu negara kepulauan, garis besarnya telah pernah dimuat di harian ini. Jadi jangan lagi menari-nari menurut irama gendang yang ditabuh orang lain. Jangan sampai anak cucu kita, generasi penerus, yang sudah kehilangan Tanah Air atau tidak lagi menjadi Tuan di negerinya sendiri akibat ulah kepicikan kita sekarang, kelak ikut-ikut kita dengan kata-kata ejekan " Dasar Indon!".

according to Amien Rais, the DPR will only ractify the treaty if TNI could train and use live bullets at Orchard road like what the SAF could do at Indonesia territory if the treaty is ractified.
