Yagami's biggest mistake was killing the 'fake' L. He gave away his location. Then again, it wasn't his fault that L was also just as smart as he was.

If I was Yagami, I would have plotted an accident or something (He is smart enough to) so people think I am dead. Then a few years later, after they forget about the accident, that is when I would start using the note.

I don't remember light kissing L. There was a fan made ending for the manga which people thought was awesome.
