Full Version: In the democracy Is it right to lets the majority vote bend on the law

It is the controversy that we always heard some politician mention on support of the majority of the vote once he got charge from the law suit. If this is OK so its mean that if a person got enough support from a mob they can jst go to the prison and ask the police to release all the raper because the majority though that raping is fine.

Wish Thailand dont go till that point its all about the mob mentallity ,not the democracy.

What about that coup when the minority hijacked democracy? How can you call the majority of the voters mob when they didnt have demonstrations even after their elected leader was overthrown by the mob junta government?

Democracy is not a perfect system... but as far as we know thus far it's the lesser of many evils. A democracy means that 51% of the population can decide the fate for the other 49%, instead of having 5% of the population control the other 95%.

I think that is something in place, here in the US, called a filabuster when a legislation cant be passed thru congress with less than something 60 or 64 votes or something like 2/3 votes between the two opposing parties.

That is how democracy work. Otherwise talk to the Junta, Communist, Dictatorship, Authoritarian....etc.

1/ If the majority of the people in the country vote Thaksin out of the jail, then let him out
If the majority of the people in the country say don't sue Thaksin then don't

2/ if the Bangkokian mob say let Thaksin out of jail, then no. They're not representing the whole country.
If the Bangkokian mob say don't sue Thaksin then no, They are not representing the whole country.

hey, that doesn't sound LOGICAL AT ALL..... it should be the judiciary who decides whether Thakky broke the law and goes in or out of jail, not the people for crissakes.

however, if the judiciary is fu-ked up like the one in Kenya where a lawsuit will take years before it is heard, and even if heard, there's corrupt judges on the panel, then i will say we need mob justice to hang the b'tard, but then that wouldn't be democracy anymore would it? no difference to klu klux klan... icon_rolleyes.gif

depends. if i murder someone in ireland because they killed my son i would get at least 20 years. if i killed him because he is catholic and i am protestant i would probably do about 4 years.....

Not when the judiciary itself is corrupted, that would be the case in siam. If the civilian government are fully in power then let the judiciary decide.

The title of judge in Thailand is given by the king and by accepting the title, they has to vow their oath to the king himself to abstain from impartiality.

Just wonder how a loas person who lives in US and can not type a word in Thai because he has no Thai keyboard, would know so much about Thai justice system. confused.gif

Thaksin was aware that siam judicial system under the Coup was corrupted, so he promised to return if only on the civilian government hands.

A Buddhist monk once told me that intelligence do not necessarily equate wisdom and might do not mean it is right. I have thought about it and still don't really know what he meant? Also he said that, just because people do things in the Buddha's name (the historical, the present and the future) do not make it right. When it comes to democracy, you guys tell me?
Majority rules can turn out to be mob rules and minority rules can be elitist rules. There is a balance that humanity have been striven for eternity. I hope someday, all human can achieved that.

here is what your sorce said about individual case,

In Thailand, the judicial system functions at a very slow pace, therefore bribing civil servants charged with overseeing regulations, in order to speed up legal procedures, is a common practice.

we are talking about Thaksin coming to court here, your point????

Fool, many don't trust the judicial system under your junta. Ask the longtime thai politician, Thaksin Shinawatra if you don't believe me. He'll tell you how thailand like. true, true.
