
THE Supreme Court's First Division yesterday ordered the Assumption Convent School in Antipolo City to explain why actress Ma. Maxene Sofia Magalona was expelled in 2001.
In a resolution, the SC gave Assumption Convent 10 days to submit their comment on the petition for review filed by Maxene's parents, popular actor-rapper Francis Magalona and Pia Arroyo.
The case stemmed from a television appearance of Maxene endorsing the product Modess feminine pads last Jan. 28, 2001 without the Magalonas first getting the permission of the school.
It was learned that one of the conditions of Assumption Convent is that no student will be permitted to appear in television advertisements without securing permission from school authorities.
Assumption officials, through school administrator Norma Aguilus, said they tried to communicate with the Magalonas regarding the matter but the latter reportedly ignored them.
Because they could not talk with the Magalonas, Aguilus told Maxene that she was being expelled last Jan. 29, 2001.
The Magalonas filed charges against the school before the Antipolo Regional Trial Court which sided with Maxene. Assumption Convent appealed.
The Court of Appeals decided Nov. 14, 2002 that the Magalonas should have filed the case first before the Department of Education.
