Here is quote from mouth of Indonesian lousy lawyer:

This lousy guy seems know very well how to win the case, everything is possible in Indonesia and by their mafia network they always think they can buy their achievement buy offering something.

I guess Indonesian legal system have to have good and transparant law, so lawyer would not become a conduit toward bribery.

What kind of lawyer of this guy who has 60 houses and 15 cars?

that hutapea guy is a typical rich man, i don't like him much coz of the way he show off his riches. now, he's using publicity to put pressure on the bali high court, i wonder if this is how he won so many cases in the past without losing. actually, sometimes i wonder if he ever used bribery to win.

Hi Mas Nus Yth,

Let me repeat myself. The second link does not lead to the article. I'm not interested in finding out who he is by googling him up. I heard about him long before Corby's case. I also mentioned him in Mbbak Putri Tini's thread. I wanted to go to the second link because you seemed to be inferring that he's got 60 hourses and 15 cars. That's the article that I'm interested in.

this lawyer hotman paris hutapea made his riches very recently, between 1998-2004 when the IMF-installed bankruptcy law made it possible for companies to be declared bankrupt when they defaulted some of their debts no matter how small it was (eg: Manulife bankruptcy case). Now the bankruptcy law has been repealed, he is diversifying to celebrity criminal or divorce cases such as this corby case. His excessively extravagant lifestyle is typical of OKB (orang kaya baru)

I can think of several other super-rich lawyers: Otto Cornelis Kaligis, Ruhut Sitompul, Elsa Syarief, and Juan Felix Tampubolon. I would think Juan Felix as possibly the richest lawyer in Indonesia bcoz he successfully defended Suharto family (the richest family in Indonesia) from prosecution for years.

Are you implying that Indonesia now does not have any bankcrupcy laws? Tolong menjelaskan, Mas.

I thought bankrupcy laws are an essential part of any mordern economy. And how exactly were these laws used/abused to enrich a few individuals?

Indonesia's bankruptcy laws was amended in 1998 based on IMF instructions, its first chapter allowing a company to be declared bankrupt if it is proven to have failed to pay debts to at least two claimants, no matter how financially healthy the company is. The IMF's aim was to force Indonesian debtors to pay up to their foreign creditors. However, in practice, this law was used against foreign investors. For example, in 2002 PT Asuransi Jiwa Manulife, the most profitable insurance company in Indonesia partly owned by Canadian insurance company Manulife was declared bankrupt by Jakarta Commercial Court because it failed to pay a dividend in 1999 to Roman Gold Assets Ltd, a British Virgin Islands-based company. In 2004, PT Prudential Life Assurance was declared bankrupt because it failed to pay a Malaysian agent $152,000 in bonuses. This is despite the fact that Prudential was very much solvent, owning $183m in assets and $108.4 m in premiums. Lawyers like Hotman Paris Hutapea was involved in representing claimaints in bankrupting many firms during those years, and that's when Mr Hutapea made his fortune and his many enemies (his diamond-encrusted pistols are not for decoration).

After it is clear that the IMF-installed bankruptcy law is disastrous to interests of foreign investors, quite contrary to its original aim, foreign pressure led to this bankruptcy law to be revised in August 2004. Now, companies' solvency must be assessed first by BI, Depkeu, and BKPM before they can be declared bankrupt. Bankruptcy cases is no longer the money-making bonanza it was for many lawyers.

When something is repealed it is withdrawn, revoked or rescinded. The bankrupcy laws were never repealed. They were instead amended.

Blaming the IMF on the failure of the applications of the bankrupcy laws is one of your favourite hobbies, Mas.

we should put the blame where the blame lies, the IMF for writing this law and forcing us to enact it beerchug.gif

there is no "failures" application of the law. both prudential and manulife can be declared bankrupt according to this ridicilous law. there is no regulation which give foreign-owned business impunity from the IMF-inspired bankruptcy law.
