NARA -- Prosecutors have demanded that a woman who constantly played loud music from a CD player at her home in Nara Prefecture over a more than two-year period, sickening a neighbor, spend three years behind bars.
Miyoko Kawahara, 58, a resident of Heguri, Nara Prefecture, is under indictment on charges of inflicting bodily injury and violence to a 65-year-old woman living near her home.
"The defendant played music extremely loudly over a long period. Her crime was persistent and sly," a prosecutor said during a hearing held at the Nara District Court on Friday. "The defendant escalated her harassment after the victim filed a lawsuit against her over the noise. Creating noise everyday constitutes inflicting bodily injury."
Moreover, the prosecutor pointed out that it had huge social impact. "Because of the incident, the neighborhood has been branded as the "town of the noisy woman."
The defense counsel denied any causal relations between the noise created by Kawahara and the neighbor's illness, and claimed that the defendant is not guilty.
Kawahara wrote her opinion criticizing the neighbor and read part of it saying, "I intend to continue my quarrel."
Kawahara constantly created loud noise at her home, using a CD player, from November 2002 to April 2005 when she was arrested, according to the indictment. The neighbor suffered high blood pressure, headaches, sleeplessness and dizziness because of the harassment and received medical treatment, prosecutors said.
